Section 301 Tariffs Being Challenged in Court
Three companies, HMTX Industries, Halstead New England, and Metroflor Corporation filed a complaint in the Court of International Trade on September 10, 2020. They are challenging both the substantive and procedural processes followed by the US Trade Representative when instituting Section 301 Tariffs on imports from China under List 3.
The companies involved in the suit seek to be refunded for the 25% additional tariffs paid on imports, plus interest, for payments made on products of the List 3 tariffs from September 2018 to present.
The lawsuit, theoretically, could mean refunds for importers with 301 duties on lists 3 and 4A.
